The right to criticize public officials (see New York Times Co v Sullivan, 1964, 376 US 254, 273, II L Ed 2d 686, 84 S Ct 710) and to petition the government for a redress of grievances (see United Mine Workers v Illinois State Bar Ass’n, 1967, 389 US 217, 222, 19 L Ed 2d 426, 88 S Ct 353) are protected activities and William Robert Bramscher advocates that his activities and criticisms focused on matters of “Public Concern” as required by Connick v Myers, 1983, 461 US 138, 75 L Ed 2d 708, 103 S Ct 1684 whereas “The First Amendment was fashioned to assure unfettered interchange of ideas for the bringing about of political and social changes desired by the people” Id at 145 (see also Roth v United States, 1957, 354 US 476, 484, 1 L Ed 2d 1498, 77 S Ct 1304, 14 OHIO Ops 2d 331).

It is this Defendants’ THEORY OF DEFENSE that the prosecution of this case is based upon retaliation by the City of Santa Cruz, California. William Robert Bramscher contends that he was exercising his First Amendment rights of FREEDOM OF RELIGION, FREEDOM OF SPEECH, FREEDOM OF PRESS and FREEDOM TO REDRESS, all protected activities, and that this prosecution is based on bad-faith investigation, legal harassment and retaliation against him Defendant for exercising his Constitutionally Protected Rights.

Mr. Bramscher is the victim

 

I. BACKGROUND

On or about 7 April 2017 Mr. William Robert Bramscher was falsely arrested while engaged in constitutionally protected activities including prayer at Oblates of St. Joseph 544 W Cliff Dr, Santa Cruz, CA 95060 (831) 457-187 with Chapel Daylight hours everyday from 7 a.m. to sunset. Mr. Bramscher was issued citations for 602(O) TRESPAS; REFUSE LEAVE PROP, 415(3) OFFENSIVE WORDS:PULBIC PL and 647(F) DISORD CONDUCT:ALCOHOL. Mr. Bramscher did regularly attend services at this church as documented on his Facebook page and other media.

II. CHARGES

Probable cause is a requirement found in the Fourth Amendment that must usually be met before police make an arrest, conduct a search, or receive a warrant.  Courts usually find probable cause when there is a reasonable basis for believing that a crime may have been committed (for an arrest) or when evidence of the crime is present in the place to be searched (for a search).  Under exigent circumstances, probable cause can also justify a warrantless search or seizure.  Persons arrested without a warrant are required to be brought before a competent authority shortly after the arrest for a prompt judicial determination of probable cause. A prosecutor has the responsibility of a minister of justice and not simply that of an advocate.  (See People v Walker, 1972, 180 Colo 84, 504 P2d 1098 in re “A prosecutors duty is to seek justice, not merely convict”; People v Drake, COA 1992, 841 P2d 364; see also People v Elliston, 1973, 181 Colo 118, 508 P2d 379 in re “A prosecutor must be careful in his conduct to ensure that the jury tries a case solely on the basis of the facts presented to it.”)

A. Mr. Bramscher has been falsely accused of violating California Penal Code Section 602(O):

Refusing or failing to leave land, real property, or structures belonging to or lawfully occupied by another and not open to the general public, upon being requested to leave by (1) a peace officer at the request of the owner, the owner’s agent, or the person in lawful possession, and upon being informed by the peace officer that he or she is acting at the request of the owner, the owner’s agent, or the person in lawful possession, or (2) the owner, the owner’s agent, or the person in lawful possession.  The owner, the owner’s agent, or the person in lawful possession shall make a separate request to the peace officer on each occasion when the peace officer’s assistance in dealing with a trespass is requested.  However, a single request for a peace officer’s assistance may be made to cover a limited period of time not to exceed 30 days and identified by specific dates, during which there is a fire hazard or the owner, owner’s agent, or person in lawful possession is absent from the premises or property.  In addition, a single request for a peace officer’s assistance may be made for a period not to exceed six months when the premises or property is closed to the public and posted as being closed.  However, this subdivision shall not be applicable to persons engaged in lawful labor union activities which are permitted to be carried out on the property by the Alatorre-Zenovich-Dunlap-Berman Agricultural Labor Relations Act of 1975 (Part 3.5 (commencing with Section 1140) of Division 2 of the Labor Code) or by the National Labor Relations Act.  For purposes of this section, land, real property, or structures owned or operated by any housing authority for tenants as defined under Section 34213.5 of the Health and Safety Code constitutes property not open to the general public;  however, this subdivision shall not apply to persons on the premises who are engaging in activities protected by the California or United States Constitution, or to persons who are on the premises at the request of a resident or management and who are not loitering or otherwise suspected of violating or actually violating any law or ordinance.

California Code California law recognizes and respects the sanctity of a person’s private property. As a result, it is a crime to enter or remain on another’s property without permission. In these instances, a defendant can be charged with trespassing under California Penal Code Section 602 PC. While there are over thirty forms of trespassing under California law, all adhere to the same basic elements. California’s law on trespass generally defines “trespass” as entry onto the property of another without permission or a right to do so. However “criminal trespass” involves more than mere unauthorized entry onto the property of another. It also requires specific intent to interfere with, or to damage, the owner’s property right or the property itself; and actual interference with or actual damage to the property. See People v. Wilkinson, 1967, 248 Cal. App. 2d. Supp. 906, endnote 16 (“substantial, continuous period of time”).

B. Mr. Bramscher has been falsely accused of violating California Penal Code Section 415(3):

The legal definition of this form of disturbing the peace is that:

Mr. Bramscher used offensive words which were inherently likely to provoke an immediate violent reaction, and

those words were spoken in a public place.

What does it mean for words to be “inherently likely to provoke an immediate violent reaction”? It means that:

The speaker said something reasonably likely to provoke someone else to react violently, AND

When s/he made the statement, there was a clear and present danger that the other person would immediately erupt into violence.

It doesn’t matter whether the defendant intended to provoke a violent response from someone. However, if the defendant reasonably believed that his/her words were NOT likely to provoke an immediate violent reaction, s/he is not guilty of disturbing the peace.

Offensive Words and Free Speech

This offense is what is known as the “fighting words” exception to the right of free speech that is otherwise guaranteed by the First Amendment to the United States Constitution. Courts will determine what qualifies as “offensive words” on a case-by-case basis. Words that are vulgar, profane, rude, abusive, or disrespectful by themselves do not warrant prosecution for this offense. It is the context surrounding the alleged “fighting words” that is critical.  The alleged word or words must be spoken in a provocative manner that is certain to provoke a violent response.

C. Mr. Bramscher had been falsely accused of violating California Penal Code Section 647(F):

In order to violate California’s “drunk in public” statute, you need to be so intoxicated that you:

are unable to exercise care for your safety or the safety of others, OR

interfere with, obstruct, or prevent others from using streets, sidewalks, or other “public ways”.

In order for you to be guilty of California drunk in public, prosecutors need to be able to show – beyond a reasonable doubt – both that Mr. Bramscher was willfully intoxicated in a public place and that he engaged in behavior that met the legal definition of public intoxication.

III. ARGUMENTS

A. FIRST AMENDMENT

The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference. See U.S. Const. amend. I. Freedom of expression consists of the rights to freedom of speech, press, assembly and to petition the government for a redress of grievances, and the implied rights of association and belief. The Supreme Court interprets the extent of the protection afforded to these rights. The First Amendment has been interpreted by the Court as applying to the entire federal government even though it is only expressly applicable to Congress. Furthermore, the Court has interpreted, the due process clause of the Fourteenth Amendment as protecting the rights in the First Amendment from interference by state governments. See U.S. Const. amend. XIV.

(1) First Amendment Freedom of Religion

Mr. Bramscher was engaged in protected activities as defined by the the FREEDOM OF RELIGION provision of the United States Federal Constitution during normal hours of operation at the church. Mr. Bramscher pleads with this Court that he is a victim of 18 U.S. Code 247 (2) whereas members or agents of Oblates of St. Joseph and/or, under color of state, the Santa Cruz Police Department and so on, did intentionally obstruct, by force and threat of force, Mr. Bramscher in the enjoyment of that his free exercise of religious beliefs, or attempts to do so.

(2) First Amendment Freedom of Speech

Mr. Bramscher, a member of The Denver Press Club, is a known writer who considers Chief Kevin Vogel of the Santa Cruz Police Department a personal friend. Mr. Bramscher insists when confronted by the Santa Cruz Police that he was engaged in activities protected by the FREEDOM OF SPEECH to include III A (4).

Under the Federal Constitutions First and Fifth Amendments, speakers are protected from arbitrary and discriminatory enforcement of vague standards (see National Endowment for the Arts v Finley, 1998, 524 US 569, 141 L Ed 500, 118 S Ct 2168, 98 Daily Journal DAR 6957, 1998 Colo J CAR 3222, 11 FLW FED S 675 (19.

Mr. Bramscher insists when confronted by the Santa Cruz Police that he was engaged in activities protected by the FREEDOM OF SPEECH to include III A (4).

B. FOURTH AMENDMENT

The Fourth Amendment of the U.S. Constitution provides, “[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

The ultimate goal of this provision is to protect people’s right to privacy and freedom from arbitrary governmental intrusions.  Private intrusions not acting in the color of governmental authority are exempted from the Fourth Amendment.

C. FIFTH AMENDMENT

The Fifth Amendment of the U.S. Constitution provides, “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

D. SIXTH AMENDMENT

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

The “Sixth Amendment Guarantee that accused in criminal proceeding shall enjoy right to have assistance of counsel means effective assistance, as distinguished from bad faith, sham, mere pretense or want of opportunity for conference and preparation” (see United States v Davis (1971, CA10 Okla) 436 F2d 679).  When Defense counsel’s representation is so blatantly incompetent as to render entire proceedings fundamentally unfair, due process clause itself is violated.  Sixth Amendment’s provision guaranteeing accused’s right to assistance of counsel for his defense is made obligatory upon states by Fourteenth Amendment (see Gideon v Wainwright (1963) 372 US 335, 9 L Ed 2d 799, 83 S Ct 792, 23 Ohio Ops 2d 258, 93 ALR 2d 733) and “[The Assistance of Counsel] is one of the safe-guards of the Sixth Amendment deemed necessary to insure fundamental human rights of life and liberty…. The Sixth Amendment stands a constant admonition that if the constitutional safeguards it provides be lost, justice will ‘not be done’,” Id at 344.

E. EIGHTH AMENDMENT

The Eighth Amendment of the United States Constitution states that: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”

The Excessive Bail section provides constitutional protection against excessive bail, including the practical denial of bail by fixing its amount unreasonably high, as decided in United States v. Motlow, 1926, 10 F.2d 657.
